The police can’t just do anything they want, even though sometimes it can feel that way. Like all of us, they are bound by the law.

Each State and Territory in Australia has a particular statute that governs what police are and are not allowed to do. For example:

  1. Police are only allowed to arrest you in limited circumstances. The deprivation of a citizen’s liberty is taken very seriously by the courts, and even if you have committed a minor offence, police may not be legally allowed to arrest you if they could simply serve a court attendance notice on you instead. If police don’t follow the lawful processes, then they may have committed an unlawful arrest;
  1. Police can only touch you or use force against you if it is necessary for them to do so to execute a lawful police power. If police use more force than is necessary, this is called excessive force, and it may constitute an assault and battery against you;
  1. Police can only strip search you in very limited circumstances. Illegal stop and search is taken very seriously by the Courts; and
  1. Police cannot maintain charges against you indefinitely. If it becomes clear you are innocent, those charges must be dropped. If police charge you with a crime you clearly didn’t commit, or target you without due cause or process, this may constitute a malicious prosecution.
